As used in this chapter, the following terms shall have the meanings indicated:
ABANDON
Any motor vehicle, omnibus, road tractor, trailer, truck, truck tractor and vehicle which:
A. 
Is parked without the current registration and identification markers as required by law, is not insured, or does not have a current/valid inspection sticker which shall be displayed as required by law;

B. 
Has been continuously parked in any of the places mentioned in this chapter for a period of 48 hours;
C. 
Is so disabled as to constitute an obstruction to traffic and the driver or person owning or in charge thereof neglects or refuses to move the same to a place where it will not obstruct traffic;
D. 
Is found to be mechanically inoperative; or
E. 
Is found without one or more tires.
OMNIBUS, ROAD TRACTOR, TRAILER, TRUCK, TRUCK TRACTOR and VEHICLE
Intended to have the meanings stated and as defined in N.J.S.A. 39:1-1 et seq.

A. 
It shall be unlawful for any person to abandon a motor vehicle, omnibus, road tractor, trailer, truck, truck tractor or vehicle on any public street or highway of the town; on any municipally owned or operated parking lot; on any property which is owned, leased or maintained by the Borough of Glassboro; on any property which is owned, leased or maintained by the Board of Education of the Borough of Glassboro; or on any property which is owned, leased or maintained by the Board of Recreation Commissioners of the Borough of Glassboro.
B. 
It shall be unlawful for any person to maintain any abandoned vehicles on any privately owned land in the Borough of Glassboro except under the following circumstances:

(1) 
Any number of abandoned vehicles may be maintained so long as they are garaged and completely out of view.
(2) 
If mechanically inoperative and/or not garaged, one abandoned vehicle may be maintained only if the owner or other authorized person is actively engaged in repairing, restoring, rebuilding, etc., said vehicle to render it operable and roadworthy. If said vehicle is maintained for a continuous period of 60 days without being rendered operable and roadworthy, it shall be presumed that the owner or other person is not actively engaged in repairing, restoring or rebuilding said vehicle; otherwise, it shall be unlawful to maintain any abandoned vehicle on private property which is mechanically inoperative and/or not garaged. Such vehicle shall be kept on a legal parking area.
C. 
The owner or lessee of any privately owned property upon which any abandoned vehicle or vehicles are parked, which do not comply with the provisions of Subsection B(1) or (2) above, shall remove said abandoned vehicle or vehicles within 48 hours of written notice served upon them by the Glassboro Police Department, Zoning Officer, Code Enforcement Officer or other authorized official of the Borough of Glassboro for said purpose. Should the person so notified fail to remove said vehicle or vehicles in accord with the terms of said notice, then the vehicle or vehicles may be removed by the Glassboro Police Department, Zoning Officer, Code Enforcement Officer or other authorized official of the Borough of Glassboro for said purpose pursuant to the procedures for removal and sale as set out in §§ 442-3 and 442-4.

A. 
Whenever any member of the Glassboro Police Department, Zoning Officer, Code Enforcement Officer or other authorized official of the Borough of Glassboro for said purpose finds any motor vehicle, omnibus, road tractor, trailer, truck, truck tractor or vehicle abandoned on any public street or highway of the Borough, or any public property described in § 442-2 of this chapter, such member of the Glassboro Police Department, Zoning Officer, Code Enforcement Officer or other authorized official of the Borough of Glassboro for said purpose shall move or secure its removal to such garage or place as may be designated by the Chief of Police of the Borough of Glassboro as a garage or place for the impounding of such vehicles, and such vehicles shall be retained and impounded until the person owning the same shall first pay the reasonable costs of the removal and storage which may result from such removal before regaining possession of the vehicle.
B. 
Whenever any vehicle is impounded as provided in this chapter, the Chief of Police, or some member of the Police Department acting for him, or the Zoning Officer, Code Enforcement Officer or other authorized official of the Borough of Glassboro for said purpose shall, within 10 days from the date of impoundment, notify the registered owner, in writing, by personal service or by certified mail at the last known address of the owner, of the removal of such vehicle, the reason for its removal and the location of the vehicle.

Whenever any vehicle impounded by the Police Department, Zoning Officer, Code Enforcement Officer or other authorized official of the Borough of Glassboro for said purpose shall remain unclaimed for a period of 90 days, the vehicle shall be sold under the direction of the Chief of Police, at public auction, to the highest bidder. Such auction sale shall take place after notice of such sale has been given at least seven days prior thereto by one publication in a newspaper circulating in the Borough, and upon mailing a copy of said notice to the owner of the vehicle by regular mail at least seven days prior to the sale. The address of the owner as shown on the records of the State Motor Vehicle Commission shall be deemed sufficient for the purposes of this chapter.

Any person who violates any provision of this chapter shall, upon conviction thereof, be punished by a fine of not more than $2,000, imprisonment for not more than 90 days or a period of community service for not more than 90 days, or any combination thereof.
