It shall be unlawful for one (1) or more persons to walk upon the streets of the City of Rolla or operate a motor vehicle upon the streets of the City of Rolla in a procession commonly referred to as a "parade" without first obtaining a permit from the chief of police as provided in this Ordinance.

Persons desiring to conduct a parade upon the streets of the City of Rolla shall first make application at least fourteen (14) days prior to the event date to the chief of police by completing a form prescribed by the chief of police which shall set forth the following: the name of the persons of organization seeking to conduct such a parade; the proposed date and time for the beginning and ending of the parade; the proposed route to be followed by the parade procession; the expected number of participants in the parade; an acknowledgement and acceptance of the Parade Rules as provided by the chief of police and such further information as the chief of police might require.

It shall be the duty of the chief of police to provide all persons desiring to conduct a parade within the City of Rolla with a copy of the Parade Rules as approved by the city council and to furnish such applicants with an application form as described above.

(a) 
Consumption or display of alcoholic beverages are prohibited.
(b) 
No parade vehicles may be operated at excessive speeds or be operated so as to break traction.
(c) 
No parade vehicles may be operated any closer than five (5) feet from a parked car or curb.
(d) 
Persons participating in a parade may not distribute gifts, merchandise, literature, hand-outs, candy or other materials from moving vehicles or parade floats during the parade. Participants may assign walkers to hand or toss items to spectators along the parade route. Walkers shall only distribute gifts, merchandise, literature, hand-outs, candy or other materials as far off the road as possible to avoid children and other spectators from running into the streets and so long as such activity does not draw spectators into the streets.
(e) 
No parade participant shall appear in a state of nudity.
(f) 
No parade participant shall conduct themselves in such a way so as to threaten, curse or offend any other person.
(g) 
Parade participants shall be responsible for cleanup after the termination of the parade activities.

(a) 
Upon the filing of a completed application form, the chief of police shall issue a Parade Permit setting forth the date, time and location of the proposed parade to the applicants. In addition, the chief of police shall have the authority to, if in his judgment the circumstances warrant, make special requirements of such applicants before issuing the permit which may include: a different parade route; a different time for the parade; a different day for the parade; the furnishing of security personnel to assist the police department in supervising the parade; and a money deposit to cover the costs of property damage or clean-up.
(b) 
In the event such application for a permit is denied by the chief of police, then the applicant or applicants may appeal to the city council for such permit, and such appeal shall be heard and determined within a reasonable time thereafter, and the decision of the city council thereon shall be final.

Any person violating the provisions of this Ordinance shall be guilty of an offense and be subject to a fine not to exceed five hundred dollars ($500.00) or imprisonment for a period not to exceed three (3) months, or by both such fine and imprisonment.
