The local enforcing agency shall be the Sussex County Fire Marshal
based on the terms of a shared services agreement established pursuant
to N.J.S.A. 40A:65-1 et seq., between the Borough and the County of
Sussex. The Sussex County Fire Marshal shall hereinafter be known
as the "local enforcing agency."

The local enforcing agency shall enforce the
Uniform Fire Safety Act and the Uniform Fire Code in all buildings,
structures and premises within the established boundaries of the Borough
of Andover, other than one- and two-unit owner-occupied dwellings
used exclusively for dwelling purposes and buildings, structures and
premises owned or operated by the federal government, interstate agencies
or the State of New Jersey. The local enforcing agency shall faithfully
comply with and shall have and has authority to enforce all the pertinent
requirements of the Uniform Fire Safety Act and the Uniform Fire Code.

The local enforcing agency shall carry out the
periodic inspections of life-hazard uses required by the Uniform Fire
Code on behalf of the Commissioner of the New Jersey Department of
Community Affairs.

The local enforcing agency established by § 70-2 of this chapter shall report to the governing body of the Borough of Andover.

Any modification to the fee schedule set forth in this chapter which shall be required by the state Division of Fire Safety, Department of Community Affairs, shall become incorporated herein by reference upon notice of the modification to the Borough by the local enforcing agency. Except as set forth in § 70-7, all other fees (life-hazard use and permits) are governed by Subchapter 2 of the state Uniform Fire Code, as amended from time to time.

In addition to the registrations required by the Uniform Fire
Code, all non-life-hazard uses shall register with the local enforcing
agency. These uses shall be inspected once per year and pay an annual
fee. The following is the fee schedule for non-life-hazard uses:
