No person shall ride or use a bicycle upon any public street in the Borough of Mifflinburg, Pennsylvania, unless the same shall be licensed and registered as hereinafter[2] provided.

Every owner of a bicycle, upon the effective date of this ordinance, shall list and register with the Police Department of the Borough of Mifflinburg, Pennsylvania, at Police Headquarters, his name and address, and name of the manufacturer of the bicycle, its number, style and general description. In the event that the owner of a bicycle is a minor under the age of 21 years, then the parent or guardian or person having the care of such minor or with whom he or she lives shall make such listing and registration on behalf of such minor owner.

The Chief of Police shall from time to time provide, at the expense of the Borough, stickers, which stickers shall have numbers stamped thereon in numerical order. Such stickers shall be suitable for attachment upon the bicycle. It shall be the duty of the Chief of Police to issue to the owner of each bicycle, who shall make application therefor and pay the required fee as hereinafter[1] provided, one sticker, which shall be attached to the rear of the bicycle, in a position to be seen clearly from the rear such sticker shall remain attached to the bicycle for which it is issued for the duration of such license period. The Chief of Police shall also keep a record of such registration.

It shall be the duty of every person who sells or transfers ownership of any bicycle to report such sale or transfer to the Police Department of the Borough of Mifflinburg, Pennsylvania, at Police Headquarters, and if such person has had his bicycle licensed and registered, he shall also return to the Chief of Police the license sticker, and furnish said Chief of Police with the name and address of the person to whom said bicycle was sold or transferred, and such report shall be made by the person selling or transferring within three days of the date of said sale or transfer. It shall be the duty of the purchaser or transferee of such bicycle to apply immediately for a license sticker.

It shall be unlawful for any person to wilfully or maliciously remove, destroy, mutilate or alter the number of any bicycle frame, and it shall be unlawful for any person to remove, destroy, mutilate or alter such license sticker during the time in which such license sticker is operative; provided, however, that if any bicycle does not have a serial number stamped on the frame, or if such number is illegible then the Chief of Police shall stamp an identification number on such frame of the bicycle.

In case of loss or destruction of a license sticker, a duplicate sticker shall be issued to the registered owner for a fee hereinafter[1] set forth; provided such owner gives satisfactory proof of same either by affidavit or otherwise, to the Chief of Police.

The license fee for the sticker shall be $0.50 for each bicycle, and shall be paid to the Chief of Police at Police Headquarters at the time of application. Said sticker shall be subject to a yearly check by the Chief of Police. Upon application for a duplicate sticker in accordance with Section 7 of the said ordinance,[1] such owner shall pay to the Chief of Police a fee of $0.25 for such duplicate sticker.

If any bicycle is found on any street in the Borough without a license identification sticker as above set forth, or with a mutilated or altered serial number, or with no serial number stamped on the frame of the bicycle, it shall be prima-facie evidence that such bicycle is being operated without proper registration, and such bicycle shall be taken and impounded by the Police Department of the Borough, and shall be held by the Police Department until ownership is proven. Any such bicycle held for six months or longer, and not claimed by the owner thereof, may be disposed of by the Borough in the manner prescribed and allowed by law.

It shall be unlawful for the operator of any bicycle when upon the street to ride with both hands off the handlebars, or in any other reckless manner or to carry any other person upon the handlebars, frame or fender of any such bicycle, or for any person to so ride upon any such bicycle.

It shall be unlawful for any person to operate a bicycle upon the streets of the Borough of Mifflinburg, Pennsylvania, without having thereon a bell or horn, light in front and rear reflectors; provided, however, that it shall be unlawful to have thereon or use a siren of any kind.

It shall be unlawful for the operator of any bicycle to violate any provision of any ordinance of the Borough applicable to vehicular traffic, and for any such violation the operator of a bicycle shall be subject to the penalty prescribed in such traffic ordinances.

It shall be unlawful for any person to operate a bicycle upon any sidewalk in the Borough, but it shall be lawful for persons to push bicycles by hand upon or across any sidewalk.

The Police Department of the Borough of Mifflinburg, Pennsylvania, may at any time require the delivery of any bicycle to it for the purpose of making inspections of brakes and other parts, and shall refuse to license or register any bicycle found to be mechanically imperfect.

It shall be unlawful for the operator of a bicycle upon any street of the Borough of Mifflinburg, Pennsylvania, to propel same abreast or to the left of any other person so propelling a bicycle, except in passing such other bicycle.

The word "streets," as used in this ordinance,[1] shall include public highways, boulevards and alleys.

Any person who shall violate any of the provisions of this ordinance,[1] except Sections 4, 5, and 6,[2] shall, for the first offense, receive a warning letter, and for the second or subsequent offenses, have said bicycle impounded by the Borough for a period of from one to two weeks, and/or pay a fine of not more than $2 and costs of prosecution, or both, at the discretion of the hearing officer. Any person who violates Section 4, 5 or 6, shall, in summary conviction before a Justice of the Peace be fined no less than $1 or more than $10, and costs of prosecution, and in default of payment of fine and costs to imprisonment for not more than 10 days.
