(a)
The
City shall have the power to provide for the ownership, establishment,
operation, and maintenance of a public municipal airport, provided
that the operation and maintenance of the airport and all supporting
property attached thereto shall be under the supervision, control,
and authority of a special board to be known as the "Harlingen Airport
Board," which shall be composed of seven (7) members with not less
than five (5) being citizens residing in the City of Harlingen, Texas,
and all being residents of Texas, with two members to be appointed
by the Mayor and one member to be appointed by each City Commissioner
of Harlingen, Texas, and approved by the City Commission of the City
of Harlingen, Texas. In the management, operation, and control of
the Airport, the Harlingen Airport Board shall be empowered to employ
an Airport Chief Executive Officer who may be hired or terminated
by the Board, but only with the prior approval and consent of the
City Commission.
Only current members who have one year or less remaining in
their term at the time of this change will continue to serve their
appointment term. The remaining members will be replaced; each resulting
vacancy shall be filled by a person appointed by a successor, by each
Harlingen City Commissioner, beginning with Place 1, and continuing
to fill each vacancy or as each vacancy subsequently arises, through
Place 5 and ending with the Mayor, with each member to be approved
by a majority of the City Commission. The expiration of each appointment
shall be succeeded by the appointment of a respective successor member
to serve for a term of three (3) years, the expiration and subsequent
appointment procedure shall continue by the city commissioners and
the mayor pursuant to the order and procedure as provided herein,
and provided that the City Commission of the City of Harlingen, Texas,
shall establish by ordinance such rules and regulations as shall be
deemed necessary to enable the board to manage the business and operation
of the airport in the best interests of the City of Harlingen, Texas,
and its citizens, and further provided that the Harlingen Airport
Board shall annually submit a budget to the Harlingen City Commission,
Texas, for approval and shall not expend airport funds except in accordance
with the approved budget or approved amendment thereto, and shall
submit detailed monthly reports covering all phases of the operation
and maintenance of the airport and supporting properties to the Harlingen
City Commission; that the City Manager and Mayor shall be ex-officio
members of the Harlingen Airport Board; and that nothing herein shall
be construed to delegate to the Harlingen Airport Board any power
that cannot be delegated by law, and all delegated powers shall be
subject to any restrictions imposed by the laws of the State of Texas
and the Charter of the City of Harlingen.
(b)
Personnel
policy. The personnel policy of the City of Harlingen shall apply
to all airport employees, except that any policy changes or amendments
must be approved by a minimum of three affirmative votes of the City
Commission before implementation.
(c)
Real
property. Any acquisition or conveyance of real property by the Harlingen
Airport Board shall be presented to the City Commission for its approval,
which must be obtained for the proposed acquisition or conveyance.
The Harlingen Airport Board shall take title to any real property
it acquires as follows: Valley International Airport, a Department
of the City of Harlingen, a municipal corporation.
