The purpose of this chapter is to establish a merit and classification system for employees.

The system of classifying employees and employee positions which has been in use by this district for many months past, and which is presently in use, is hereby confirmed and approved and is declared to be a merit system. Employees shall be classified by the board of directors and employee positions shall be classified by the board of directors in the manner presently in use in the district, and the rate of compensation for each classification and the rate of advancement therein shall be as presently established by the resolutions and motions of this board theretofore adopted, subject to modification and amendment from time to time as this board may find to be appropriate. Each employee shall be entitled to reclassification from time to time in accordance with his changing skills and proficiency and he shall be so reclassified and shall be so reclassified and shall receive compensation according to the established scale for the new or changing position or job classification.

Where applicable, all of the provisions of Title 3 of this code relating to personnel are declared to be a portion of the merit system of employment of this district, as they presently exist or as they shall be changed from time to time as current conditions and requirements may dictate. The board of directors may adopt such rules and regulations necessary to effectuate the provisions of the chapter and title.

Present and future employees of the district shall be subject to discharge without cause, if and when the classification of employment in which they may be working from time to time, shall be terminated.

All positions shall initially be filled on a merit basis, determined by examination either written or oral, or both. Such examination shall be given by the general manager, the division manager or by the personnel department on the basis of questions or sample performance, in a manner which shall be determined to be appropriate for the classification involved. The person to be employed shall be selected by the general manager from among those who satisfactorily pass such test, except for employment in grades 20 and above, which selection shall be determined by the board of directors.
