The provisions of Chapter 1 of the California Building Code 2022 Edition and the 2022 California Administrative Code are hereby adopted as the administrative provisions for all of the state building standards adopted in this Title 18 and shall be the administrative, organizational and enforcement rules and regulations for the technical codes set forth in Title 18. There is one copy of said code on file in the office of the building official for use and examination by the public.

The building official is appointed by the city manager, or by the city council, if an independent contractor. The building official and authorized representatives that enforce the technical codes set forth in this title may be employees of the city or an independent contractor.

The city of Fountain Valley hereby establishes a process to hear and decide appeals of orders, decisions and determinations made by the enforcing agency relative to building standards published in the California Building Standards Code, or any other applicable rule or regulation adopted by the department of housing and community development, or any lawfully enacted ordinance by the city relating to the same, including Title 18 of the Fountain Valley Municipal Code. The city planning commission shall serve as the city's local appeals board for this purpose. Members of the appeals board(s) shall not be employees of the enforcing agency and shall be knowledgeable in the applicable building codes, regulations and ordinances as determined by the governing body of the city.
Except as otherwise provided in law, any person, firm or corporation adversely affected by a decision, order or determination by the city relating to the application of building standards published in the California Building Standards Code, or any other applicable rule or regulation adopted by the department of housing and community development, or any lawfully enacted ordinance by the city relating to the same, including Title 18 of the Fountain Valley Municipal Code, may appeal the issue for resolution to the local appeals board as appropriate.
A decision of the local appeals board may be appealed by following the procedures for appealing a decision of the planning commission contained in Chapter 21.60 of this code.

Any person, firm, or corporation violating any of the provisions of the building codes as set forth in this title is guilty of a misdemeanor and upon conviction thereof shall be punishable by a fine of not to exceed one thousand dollars or by imprisonment in the County Jail for not to exceed six months, or by both such fine and imprisonment. Each separate day or any portion thereof during which any violation of the building codes occurs or continues shall be deemed to constitute a separate offense, and upon conviction thereof shall be punishable as herein provided.
