A police department for the city of Fountain Valley is established.

The police department shall consist of a chief of police and
such subordinate officers and personnel as are necessary to enforce
the laws and keep the peace within the city.

The chief of police shall report to the city manager, in writing
without delay, any dereliction of duty or misbehavior of any police
officer and shall attend upon any and all investigations that may
be held by the city manager relating to the conduct of any police
officer.

The chief of police shall have the authority to issue and promulgate
written orders, policies, rules and regulations governing the operation
of the department and the conduct of its personnel.

All police officers shall, at all times, be subject to the orders
of the chief of police and shall be subject to call by the chief of
police at any time during the day or night.

All advancements to the next higher classification and salary
increase shall be made according to the ordinances, resolutions and
memorandum of understanding of the city.

The chief of police shall be appointed by the city manager with
approval by the city council.

It shall be the duty of each and every member of the police
department to enforce impartially all the laws and statutes of the
United States and of the state of California, all ordinances of the
county of Orange and the city of Fountain Valley within the limits
of this city, and to perform such other and further duties as statute
and ordinance now existing or hereafter enacted that may be imposed
upon them in their capacity as peace officers.

Sworn members of the police department are authorized to make
arrests and detain prisoners in all cases where a peace officer is
so authorized under the laws of the state of California.

It is unlawful for any person to willfully make to the police
department, or any police officer in the police department, any false,
misleading or unfounded report for the purpose of interfering with
the operation of the police department or police officer, or for the
purpose of inducing or causing to be issued a complaint or indictment
against any person, firm or corporation.

The chief of police and officers shall have the same powers
that are now or may hereafter be conferred by the laws of the state
of California, and shall be entitled to the same protection as set
forth by state laws.

It shall be the duty of the chief of police and all officers
to help or assist in the prosecution and investigation of all violations
of any ordinance or laws that come to the attention of the police
department.

Pursuant to Penal Code Sections 13510(c) and 13522 the city
of Fountain Valley, while receiving aid from the state of California
pursuant to said law, will adhere to the standards for recruitment
and training established by the California Commission on Peace Officer
Standards and Training and will adhere to the training and recruitment
standards established for public safety dispatchers.

Pursuant to Government Code Section 7070 et seq., the city has
adopted a military equipment use policy. The city council has reviewed
the military use policy prepared by the Fountain Valley police department
and approves of the same. This policy shall be reviewed at least annually
by the city council in accordance with the law.
