(a) 
The operation or use of a motor vehicle in violation of the provisions of Section 27-74 through Section 27-130, except Section 27-76, Section 27-77, Section 27-82, Section 27-89, Section 27-90 and Section 27-91, shall be prima facie evidence that said motor vehicle was at the time of such violation controlled, operated and used by the owner thereof.
(b) 
If any vehicle is found upon a street in violation of the sections to which this section applies, the owner or person in whose name such vehicle is registered in the records of any city, county or state shall be held prima facie responsible for such violation, if the driver thereof is not present.

No driver of a school bus shall take on or discharge passengers while the vehicle is upon the public streets or thoroughfares of the city, unless the vehicle so stopped is plainly visible for at least two hundred (200) feet in each direction to drivers of other vehicles upon the public streets and thoroughfares of the city and then only for such time as is actually necessary to take on and discharge passengers.

The driver of a vehicle upon any public street or thoroughfare of the city, upon meeting or overtaking from either direction any school bus which has stopped on the public streets or thoroughfares for the purpose of receiving or discharging any school children and whose driver has in the manner prescribed by law given the signal to stop, shall stop the vehicle before reaching such school bus and shall not proceed until such school bus resumes motion, or until signaled by its driver to proceed.

All vehicles, not in motion, shall be parked with their right sides parallel to the curb and as near the right-hand side of the street as practicable, except on streets where vehicles are obliged to move in one direction only and on streets where angle parking is permitted; provided, that this Section shall not apply to motor vehicles designed for and being used for the loading or unloading of goods and merchandise during the periods from 9:00 A.M. to 11:00 A.M. and from 2:00 P.M. to 4:00 P.M. on Pine Street between Sixth Street and Twelfth Street.

A violation of any ordinance of the city, which regulates or prohibits parking, other than an ordinance which contains a specific penalty provision, shall be punished by a fine of not less than ten dollars ($10.00) and not more than one hundred ten dollars ($110.00). As part of its general authority to establish a traffic violations bureau, the court shall have authority to establish specific fine amounts for frequent parking violations.  No court costs shall be assessed. If the full fine is not paid within such period, then court costs shall be assessed as in other ordinance violation cases.

It shall be unlawful for any owner/operator of a motor vehicle, trailer, or construction equipment, to park on private property or on a public roadway within five (5) feet of, or in such a way as to obstruct any mailbox or delivery device which is serviced by the United States Postal Service.

The driver or operator of any motor vehicle shall cause his vehicle to come to a full and complete stop when a train is approaching and the signals are active.

(a) 
It shall be unlawful for any person to park any motor vehicle, to which is attached and upon which there is displayed a dealer's license plate, upon the public streets within the city for a longer period of time than eight (8) hours in any twenty-four-hour period; provided, that this subsection shall apply to motor vehicles parked in front of the owner's real property or place of abode or in front of the driver's real property or place of abode, if the driver be regularly employed by the owner of such vehicle. It shall be unlawful for any person to cause or permit any motor vehicle registered in his name, and to which is attached a dealer's license plate, to be unlawfully parked as provided in this subsection; provided, that this subsection shall not apply to motor vehicles parked in front of the owner's real property or place of abode or in front of the driver's real property or place of abode, if the driver be regularly employed by the owner of such vehicle.
(b) 
Police officers are hereby authorized to have removed from any street or highway to a service station, garage or other place of safety any motor vehicle, truck, tractor-driven trailer, trailer not connected with a truck, house trailer, bus, equipment, tools, machinery or vehicles used in excavation or construction of any kind which are parked or left unattended in violation of this Section. A report showing the location of the stored vehicle, trailer or equipment shall be filed by the police officer who authorized its removal with the chief of police, who shall notify the owner of the location of the vehicle, trailer or equipment.
(c) 
The owner of any vehicle, trailer, or equipment removed from any street or highway under the provision of subsection (b) of this Section, or the holder of a security interest in the vehicle, trailer or equipment, which interest is in default, may reclaim it from the service station or garage upon proof of ownership, or valid security interest which is in default, and full payment of all charges for the towing and storage of the vehicle.
(d) 
No service station or garage towing and storing a motor vehicle, trailer or equipment under the provision of subsections (b) and (c) of this Section shall charge a fee in excess of ten dollars ($10.00) for towing the vehicle and one dollar ($1.00) per day for each day the vehicle, trailer or equipment shall be stored.

(a) 
Parking trucks, tractors, commercial trailers, buses, car haulers, box trailers or stock trailers on city streets. Parking of these type trailers, either attached or unattached, is prohibited on any street within the City of Rolla, Missouri, provided, however, that this prohibition shall not apply to trailers in the act of loading or unloading from such trailers. No person shall park a truck, tractor, or trailer having a licensed capacity of more than 18,000 pounds or any bus on any street within the City of Rolla, Missouri, except for the purpose of loading and unloading such vehicle; however, that this prohibition shall not apply to those vehicles commonly known as pickup trucks licensed for 18,000 pounds or more which are parked without full cargo or construction vehicles engaged in the current act of construction or motor homes which are able to be parked on private property or church owned buses which are able to be parked on private property.
(b) 
Obstructing traffic signals and signs. No person shall park a truck, tractor, trailer or other vehicle, including recreational vehicles, on any street (residential or otherwise) within the City of Rolla, Missouri, in such a location and in such a manner as to obstruct the visibility of any traffic control or of any other vehicular traffic.
(c) 
Repairing or reconditioning. No person shall use any street within the City of Rolla, Missouri, for the purpose of repairing or reconditioning any truck, trailer, or any common carrier or any part thereof, except when such repairs shall be necessary by an emergency.
(d) 
Parking boats, trailers or recreational vehicles. No unattached boat, trailer or recreational vehicle shall be parked on any street in the City of Rolla, Missouri, however, that this prohibition shall not apply to those vehicles commonly known as recreational vehicles (RVs or motor homes) which are in use by someone other than the owner of the property directly abutting the street where such vehicle is parked. This provision is for visitors using their RVs for lodging while visiting. Although this provision is for no more than seventy-two (72) consecutive hours except where permitted.
(e) 
Violations and penalties. Any violation of this Section shall be punished pursuant to the general penalty provisions of Section 1-7 of the Code of the City of Rolla, Missouri, and Section 27-80, Section 27-81 and any other ordinances or parts of ordinances in conflict therewith are hereby repealed.

(a) 
Definitions. The following definitions shall apply to the sections of this Ordinance:
COMBUSTIBLE LIQUID
A liquid having a flash point at or above 100° F. (37.8° C.).
CORROSIVE MATERIAL AND SUBSTANCE
Slow oxidation by chemical reaction of a corrosive material.
FLAMMABLE GAS
Any ignitable gas or vapor.
FLAMMABLE LIQUID
A liquid having a flash point below 100° F. (37.8° C.) and having a vapor pressure not exceeding fifty (50) pounds per square inch (absolute) at 100° F. (37.8° C.) and shall be known as Class I liquid.
(b) 
Parking prohibited: It shall be unlawful to park any vehicle, truck, railroad car, or other conveyance placarded or signed as transporting combustible or flammable liquid, flammable gas, corrosive materials or substances, or explosives for any purpose other than loading or unloading such conveyance except in areas of the City of Rolla which are zoned M-2, Heavy Manufacturing District.
(c) 
Loading or unloading: The loading or unloading of combustible or flammable liquids, flammable gases, corrosive materials and substances, or explosives shall be supervised and witnessed by a person of lawful age.
(d) 
Spillage: Persons parking any vehicle or conveyance on any public right-of-way for the purpose of loading or unloading shall take care to prevent spillage or loss of materials being loaded or unloaded. In the event that spillage occurs, person or persons responsible for such loading and unloading shall remove all such material or goods spilled and be liable for the cost to restore the public right-of-way to its original condition. Failure to comply with this Section shall be an offense punishable under this Ordinance and each day that said failure continues shall be deemed a separate offense.
(e) 
Clean-up costs: Persons spilling any combustible or flammable liquid, flammable gas, corrosive material or substance, or explosive shall be responsible to reimburse the City of Rolla for reasonable clean-up costs and environmental damage. Such payment shall be made within thirty (30) days of receipt of statement of charges. Unless any extension of time is granted by the city in writing, each day in excess of thirty (30) days following receipt of statement of charges wherein payment to the City of Rolla is not rendered shall constitute a separate offense punishable under this Ordinance.
(f) 
Penalties: A violation of any section of this Ordinance shall be a misdemeanor punishable in accordance with Section 1-7, Code of the City of Rolla, Missouri.

(a) 
It shall be unlawful for any person to park and leave unattended upon the public streets, alleys or thoroughfares of the city, any equipment, tools, machinery or vehicles used in excavation or construction of any kind, without first having obtained a permit from the chief of police of the city, for the parking of such equipment, tools, machinery or vehicles.
(b) 
Permits authorized by subsection (a) hereof shall state the exact location of such equipment, tools, machinery or vehicles, and shall be issued for a period of not more than thirty (30) days.
(c) 
No permit shall be issued by the chief of police until he has ascertained that such parked and unattended equipment, tools, machinery or vehicles will be properly lighted during the hours of darkness.

The driver of a vehicle shall cause his vehicle to come to a full and complete stop before entering the intersections named below, and he shall then proceed cautiously, yielding the right-of-way to any pedestrian within any crosswalk adjacent to the intersection and to any vehicle either in the intersection or approaching so closely thereto, when not required to stop, as to constitute an immediate hazard. (a) 
Parking prohibited — On certain municipal lots.
(1) 
Parking lot in Buehler Park, no motor vehicles shall be parked on the west side of the municipal parking lot, situated west of Fairgrounds Road and bounded by Buehler Park in the city.
(b) 
It shall be unlawful for any person to cause or permit any motor vehicle registered in his/her name to be unlawfully parked as set out in this Section.

It shall be unlawful for any unauthorized person to park, cause to be parked, or to enter for the purpose of parking any motor vehicle or other wheeled vehicle on any private parking lot in the city as hereinafter defined.
(a) 
Private parking lot as used in this Section means any real estate within the City of Rolla, Missouri designated as a private parking lot by the owner thereof and marked by signs conspicuously posted at the entrance to the parking lot, said signs to be of at least three (3) square feet in size and to contain the words "Private Parking Lot," or words of similar effect sufficient to give notice to the public of the use of the said real estate as a private parking facility. Unauthorized person as used in the section means any person not authorized by the owner of the lot either by private contract or by appropriate language on the posted sign referred to above such as "Parking limited to the customers of _________________" or words of similar effect.
(b) 
Upon written complaint to the police department of the City of Rolla by the owner of the parking lot or by his agent or by an individual renting designated space in the private parking lot, the police department of the City of Rolla shall cause the violating vehicle to be ticketed.
(c) 
Any person convicted of a violation of this Section shall be subject to a fine, as established under Section 27-80, plus any additional court costs that may apply.

It shall be unlawful for any person to cause or permit any motor vehicle registered in his/her name to be unlawfully parked as set out in this Section.

(a) 
Between the hours of 8:00 A.M. and 5:00 P.M., except on Sundays, Saturdays and legal holidays, no motor vehicle shall be parked for a period of time longer than two (2) hours, on the following streets or parts of streets:

The Public Works Director is authorized to designate to holders of valid parking permits the assignment of a parking space on select City-owned parking lots.
(a) 
Requirements:
(1) 
To purchase a permit, the applicant must provide the following information:
a. 
Current vehicle registration and license number of the vehicle.
b. 
Driver's license.
c. 
Home address.
d. 
Day time telephone number.
(2) 
To purchase or renew an annual parking permit, all outstanding parking fines must be paid in full.
(3) 
If the vehicle is changed at any time during the year, it is the permit holder's responsibility to attend to the transfer of the parking sticker by contacting the City of Rolla. If this does not occur and the vehicle is towed, it shall be at the permit holder's expense.
(b) 
Billing/Replacement:
(1) 
All parking permits must be paid for through the City of Rolla Finance Department by cash, check, credit card, or debit card.
(2) 
Permits will be issued by the City of Rolla Public Works Department on a first come, first served basis.  Every effort will be made to accommodate the permit holder's choice of parking spaces when feasible.
(3) 
Permits will be issued in six-month and twelve-month increments.
(4) 
A six-month permit may be obtained for one hundred twenty dollars ($120.00).  There are no refunds for this purchase.
(5) 
A twelve-month permit may be obtained at a discounted rate of two hundred dollars ($200.00).  There are no refunds for this purchase.
(c) 
Renewing/Cancelling/Transferring:
(1) 
Permits must be renewed thirty (30) days in advance.  If the permit holder chooses to terminate the permit, all applicable parking stickers must be removed and destroyed.
(2) 
Individual permit holders who are terminating may not transfer their permit to another person without the expressed consent of the City of Rolla.
(3) 
Permit fees more than thirty (30) days past the permit period are considered delinquent and may result in the parking permit being issued to another user.
(d) 
Space assignment:
(1) 
The City reserves the right of assignment of permitted spaces.
(2) 
Assignments will be made to the first eligible applicant on the appropriate waiting list.
(e) 
Parking sticker placement:
(1) 
The permit coincides with a pre-numbered parking space in a specified parking lot.  The permit is nontransferable and does not entitle the permit holder to park in any other permitted facility.
(2) 
The permit holder shall receive one (1) parking sticker per permit cycle.
(3) 
The parking sticker shall be attached in a conspicuous location on the rear driver's side of the vehicle, should be unobstructed, and should be observable to a traffic officer in a vehicle.  The parking sticker must match the allotted parking space.
(f) 
General:
(1) 
Failure to comply with the regulations may result in the issuance of citations, fees, fines, vehicle immobilization, towing of vehicle, collections, and/or further legal action.
(2) 
Any person convicted of a violation of this Section shall be subject to a fine, as established under Section 27-80, plus any additional court costs that may apply
(3) 
Backing in to a parking space is prohibited and will result in a ticket.
(4) 
All improperly parked vehicles will be ticketed.
(5) 
Parking permits shall not be sold or leased.
(6) 
Improper use of the permit will be grounds for revocation of the permit.  Vehicles displaying an expired or revoked permit will be subject to issuance of a citation.
(7) 
The City of Rolla shall not be held responsible for vandalism, thefts, or problems with vehicles parked on the lot.
(8) 
Replacement parking stickers shall be available for a five dollars ($5.00) fee.
(9) 
Up to two (2) vehicles may be registered to each parking permit provided both vehicles are registered to the same permit applicant.

No motor vehicle shall be parked for a period of time longer than ten consecutive hours, excluding weekends, unless otherwise posted on the following municipal lots:

Parking lot between Eighth Street and Ninth Street, west of Oak Street.

Parking lot between Ninth Street and Tenth Street, Elm Street and Oak Street, except for the four (4) designated "Visitor Parking Spaces" at the southwest corner of the parking lot.

Parking lot between Seventh Street and Eighth Street, along the west side of Elm Street. No parking between the hours of 1:00 A.M. and 5:00 P.M., excluding weekends, unless otherwise posted.
.04 
Parking lot on the north side of Eighth Street and the west side of Rolla Street. No parking between the hours of 1:00 A.M. and 5:00 A.M.
.05 
Parking lot on the east side of Park Street and the south side of Eighth Street and the west side of Main Street. No parking between the hours of 1:00 A.M. and 5:00 A.M.
.06 
Parking lot being that portion of Cedar Street between Fourth Street and Fifth Street and also being lots 141, 142, 143 and 144, Block 5 of the James Addition to Rolla.

Parking lot between Fifth Street, Sixth Street, Elm Street, and the Burlington Northern Railroad tracks, except for the numbered lots. No parking between the hours of 1:00 A.M. and 5:00 A.M.

(a) 
Seventy-two (72) hour parking limitations: It shall be unlawful for any person to park a vehicle upon any street in the City of Rolla, Missouri for a period in excess of seventy-two (72) consecutive hours.
(b) 
Definitions: For the purpose of this Ordinance, the term “street” shall mean the entire width between the lines of every way publicly maintained when any part thereof is open to the uses of the public for purposes of vehicular travel; the term "vehicle" shall mean any vehicle in which title must be registered with the Department of Revenue of the State of Missouri.
(c) 
Exceptions: This Ordinance shall not apply to vehicles which are parked upon a street that directly abuts property owned by the registered owner of said vehicle, nor shall it apply to vehicles registered to persons residing on the property directly abutting the street where such vehicle is parked.
(d) 
Any person convicted of a violation of this Ordinance shall be subject to a fine, as established under Section 27-80, plus any additional court costs that may apply.

(a) 
Location.

It shall be unlawful for any person to park or cause to be parked a motor vehicle upon that portion of right-of-way and property owned by the Railway Company, lying west of the main tract of the Railway Company and between Seventh Street and Tenth Street, in the city, except as provided in this Section.
(b) 
Parking of vehicles for the purpose of transacting business or the loading and unloading of freight, shall not be deemed a violation of this Section.
(c) 
It shall be unlawful for any person to cause or permit any motor vehicle registered in his/her name to be unlawfully parked as set out in this Section.

(a) 
All motor vehicles, and all other vehicles, including bicycles, motorcycles, carts and wagons, shall be parked adjacent to and parallel to the curb on each side of the street, with such vehicle facing in a designated direction, on such designated streets as follows:
1. 
Elm Street, between the intersection of Ninth Street and Tenth Street, in a southerly direction only.
2. 
Fourth Street, between the intersection of Rolla Street and Pine Street, in an easterly direction only.
3.

Where a parking space has been painted or marked by authorized city personnel, a vehicle parked in such space shall be parked fully within the limits of the marked boundaries of such space.
