There is a need to regulate the times and set-up for carnivals and to establish certain guidelines and requirements for the application of such.

The application [shall] be made a minimum of two (2) months ahead of arrival of a carnival setup and a fee in the amount established by city council [shall] be paid at the time of application. The application will be approved upon the following stipulation: No carnival shall infringe upon another carnival within a total two-month period of time.

The carnival or dba will be responsible for all insurance as necessary for the protection of the patronage and must provide certification of insurance at time of application.

All applicable state or federal fees/taxes [shall] be paid by the business applying for the permit.

Any violation of this article shall constitute an offense. The fine for such an offense shall be in accordance with the general penalty provided in section 1.01.009 of this code per each day of each offense.
