The position hereby created shall be filled by appointment by a majority vote of the city council. The person so appointed shall hold such position at the pleasure of the city council and under such terms and conditions as hereafter set forth.

(a) 
General powers and responsibilities.
The general powers and responsibilities of the city administrator are as follows:
(1) 
Coordinate the administrative functions of all departments and divisions within the municipality.
(2) 
Attend all regular and special city council meetings with the right to take part in discussion of such meetings.
(3) 
Recommend to the city council for adoption such measures as he may deem necessary or expedient.
(4) 
Take appropriate action whenever laws or ordinances of the city are being violated.
(5) 
See that all terms and conditions imposed in favor of the city or its inhabitants, in any public utility franchise, are faithfully kept and performed and, upon knowledge of any violation thereof, to call same to the attention of the city attorney for proper action.
(6) 
Keep the city council at all times fully advised as to the financial conditions and needs of the city.
(7) 
Be the finance officer of the city and be responsible for the preparation and submission to the city council of the annual budget after receiving estimates made by the heads of the various departments. This provision shall in no way abrogate the authority of the city council to alter and approve the budget.
(8) 
See that the city operates within its budget.
(b) 
Responsibilities to the city council.
The city administrator shall be responsible to the city council for the proper administration of all city affairs placed in his hands and to enforce compliance of this article in its entirety.
(c) 
Administration.
(1) 
Each department head is responsible for the complete and economical operation of his department. Each department head shall coordinate his departmental activities with other city departments through the city administrator. All requests for information shall be furnished by department heads as may be required by the city administrator. Council directives to department heads, unless otherwise specified by the city council, shall be relayed through the city administrator. This provision, however, in no way abrogates the right of any employee to appear before the city council on appeal of grievances.
(2) 
The city administrator shall have the authority to prepare and submit periodic recommendations or approval by the city council that prescribes administrative practices and procedures for the city. These recommendations will include those practices and procedures that are currently in effect, and any additions, deletions or changes that the city administrator may feel would enhance the proper administration of city business. Such recommendations should include such items as purchasing procedures, equipment use, personnel practices and procedures, payroll, departmental practices and procedures, and any other items that may be appropriate. Such recommendations may be revised by the city council as the need arises.

The city administrator shall be the finance officer of the city. His responsibilities in such capacity shall include the following:
(1) 
Compile the estimates of revenue and expenditures for the budget.
(2) 
Supervise and be responsible for the purchase, storage and distribution of all supplies, materials, equipment and other articles used by any office, department or subdivision of the city government.
(3) 
Be responsible that a monthly statement of all receipts and disbursements in sufficient detail to show the exact financial condition of the city is submitted to the city council.
(4) 
The city administrator shall have those duties and responsibilities of a city treasurer as set forth in section 22.075, Texas Local Government Code.

The person appointed to the position of city administrator shall receive such compensation for his services as the city council may from time to time authorize.

The person appointed to the position of city administrator shall give bond in favor of the city in such amount and in such form as the city council may require, with sufficient security to be approved by the city council, conditioned for the faithful discharge of his duties.

The person appointed to the position of city administrator shall comply with the provisions of the constitution and statutes of the state applicable to the administration of city affairs.

(a) 
All directives, instructions or orders to department heads or other city employees from the city council shall be made through the city administrator.
(b) 
The procedural requirement set forth in this article is established for the purpose of providing a proper chain of command in regard to the routine administrative functions of the city and shall not apply in case of emergency or where such requirement would be contrary to the laws and constitution of this state.
(c) 
Provided, further, such requirement shall not prohibit direct instructions or orders between the city council and the city secretary in matters related to the city secretary’s statutory duties as the official city secretary, but shall apply to the additional clerical functions which are performed by the city secretary under the direction of the city administrator.
