If any person discharges industrial or other wastes or sewage
into the city’s wastewater facilities contrary to the provisions
of this article, federal or state pretreatment requirements, or any
order of the city, the city attorney may commence an action for appropriate
legal and/or equitable relief in a court of competent jurisdiction.
Such action(s) may include temporary or permanent injunctive relief,
as appropriate, which restrains or compels the performance of specific
activities by the user. A petition for injunctive relief shall not
be a bar against, or a prerequisite for, taking any other action against
the user. In addition, the city may recover reasonable attorney’s
fees, court costs, court reporter’s fees and other expenses
of litigation.
