The following words and phrases, as used in this division, shall be construed to have the meanings ascribed to them in this section:
Curbline.
The boundary of that portion of any street which is improved, designed or ordinarily used for vehicular traffic.
Plant.
Any hedge, shrub, vine, palm or other vegetation, except trees.
Property line.
The boundary line of any street, which line marks the division between the street area and the property abutting upon same.
Sidewalk area.
That portion of land between the curb of the street and one (1) foot inside the sidewalk or, if there is no sidewalk, that area extending seven (7) feet inside the curb in the direction of the abutting property.
Street.
The entire width of every way or place of whatsoever nature, when any part thereof is open to the use of the public, as a matter of right, for the purpose of traffic.
Traffic.
Any pedestrians, riders of animals and drivers or riders of vehicles, while using any street for the purpose of travel.
Vehicle.
Any and every device in, upon or by which any person or property is or may be transported or drawn upon a street, including devices or vehicles, such as bicycles and tricycles, moved by human power.

(a) 
The city manager is hereby authorized and directed to supervise and direct the planting of trees, flowers or shrubs in the parkways between the sidewalk and the curb of the streets in the city. It shall be unlawful for any person to plant or cause to be planted in any parkway any tree, flower or shrub without first obtaining a written permit from the city manager to do so. The permit shall state the kind and character of the trees, flowers or shrubs to be planted and the particular location on the street in the parkway where the same are to be planted.
(b) 
Any person who shall willfully interfere with the planting of trees, flowers or shrubs in the parkway on any street within the city shall be deemed guilty of a misdemeanor.

It shall be unlawful for any person, his agents, servants or employees, either as owner or occupant of any lot in the city, to place or maintain, or permit or cause to be placed or maintained thereon, any tree or plant about or near any fire hydrant, stop sign, yield sign or other official traffic-control sign, so as to hide or partially hide such hydrant or sign from the view of passing traffic.

It shall be unlawful for any person, his agents, servants or employees, as owner or occupant of any lot in the city, to place, maintain or permit, or cause to be placed or maintained, any tree or plant on or in the sidewalk area abutting such lot, in such a way as to obstruct the free passage on and the free use of that area by the public.

It shall be unlawful for the owner or occupant of any property in the city, or his agents, servants or employees, to maintain or permit limbs of trees growing thereon to overhang or grow about the sidewalk area abutting such property, unless such limbs and all branches and foliage thereon are kept trimmed and pruned to a minimum clearance of ten (10) feet above the street level at the nearest curbline.

(a) 
Maximum height of vegetation, fences, etc.
It shall be unlawful for any person, his agents, servants or employees, to place, cause to be placed or suffer any plants, trees, shrubbery, vegetation, fences, vehicles, machinery, materials, structures or objects having a height greater than three (3) feet above the level of the center of the nearest abutting street, on or in that portion of any corner lot which is included in a triangle on the street corner of the lot formed by a diagonal line intersecting the property lines at points twenty (20) feet from the street corner intersection of the property lines.
(b) 
Penalty.
Any person violating any of the provisions of this section shall be guilty of a misdemeanor, and upon conviction shall be punished as provided in section 1.01.009 of this code.

The city manager is hereby authorized to remove or cause to be removed any trees, limbs or plants found between the opposite curblines in any street in the city and to trim branches, limbs or foliage of any tree or plant which overhangs or grows above the area which lies between the opposite curblines of any street, so as to provide a minimum clearance of ten (10) feet above the street level at the curbline and so as to be graduated toward the center of the street to a clearance of fifteen (15) feet above the street level at the center of the street.

(a) 
It shall be the duty of the chief of police to cause a written notice to be served upon the owner or occupant of any property, upon which any violation of this division exists, to correct such condition as constitutes such violation, within ten (10) days after the service of such notice. If such condition is not corrected or remedied or caused to be corrected or remedied by such person by the end of such ten-day period, the city manager is hereby authorized and directed to cause the tree or plant or any part thereof constituting such violation to be trimmed, pruned or removed, so as to eliminate the prohibited condition.
(b) 
Any person who fails or refuses to comply with a notice served upon him pursuant to subsection (a) of this section, and fails or refuses to abate the condition shown therein within ten (10) days after receipt of such notice, shall be guilty of a misdemeanor. Each day such condition exists shall constitute a separate offense.
