The department of parks and recreation shall promulgate any and all necessary rules and regulations for the use by the public of the city aquatic facility.

The city aquatic facility shall be open to the public on the following days and at the following times:

(a) 
The department of parks and recreation shall charge the fees to the public as set forth in the fee schedule in appendix A of this code, under the following requirements, for use of the city aquatic facility.
(b) 
Pool rentals are subject to the following requirements:
(1) 
All reservations must be made at least one (1) week in advance of the event by contacting the department of parks and recreation.
(2) 
The pool is available for reservation between the hours of 8:00 p.m. to 10:00 p.m. on Thursdays, Fridays, and Saturdays.
(3) 
Time needed for setup and cleanup shall be included as part of the reservation time and will be charged accordingly.
(4) 
Decorating items shall be the responsibility of the renter, and only tape may be used to affix decorations to walls, posts, etc.
(5) 
The standard reservation includes three (3) staff members for the rental. Unless the permit states otherwise, the maximum number of people in the facility is 75. In cases where the permit shows that more than 75 people will be attending, additional staff shall be scheduled.
(6) 
Rentals shall be responsible for any and all damages to the facility occurring during and as a result of renter’s use of the facility.
(c) 
The day care group rate is as set forth in the fee schedule in appendix A of this code. Arrangements must be made for day care by contacting the department of parks and recreation.
(d) 
The department of parks and recreation shall set all other fees as may be necessary.
(e) 
The program fee is created for the purpose of recovering the city’s expenses for instructors and pool times for such programs as water aerobics, swimming lessons, water walking, etc.
(f) 
The department of parks and recreation may establish a scholarship program to assist economically disadvantaged families and individuals in improving their quality of life through recreational opportunities. Such scholarships will be available for all programs and amenities at the city aquatic facility.

Any person violating any of the provisions of this division shall be guilty of a misdemeanor, and upon conviction shall be fined in any sum in accordance with the general penalty provided in section 1.01.009 and each and every day’s continuance of any violation of this division shall constitute and be deemed a separate offense.
