(a) 
Creation.
There is hereby created in accordance with section 25 of the charter of the city the department of parks and recreation, whose head shall be known as the director of parks and recreation.
(b) 
Purpose.
The purpose of the department of parks and recreation shall be to plan and develop parks and open space for the city and to develop recreational programs to meet the needs of the citizenry of the city.

(a) 
The director of parks and recreation is hereby authorized and directed to supervise and direct the planting of trees, flowers or shrubs in the parks of the city. It shall be unlawful for any person to plant or cause to be planted, in any city park, any tree, flower or shrub, without first obtaining a written permit from the director of parks and recreation to do so. The permit shall state the kind and the character of the trees, flowers or shrubs to be planted and the particular location in the park where the same are to be planted.
(b) 
Any person who shall willfully interfere with the planting of trees, flowers or shrubs in any city park shall be deemed guilty of a misdemeanor.

The property known as “The Wise Memorial” heretofore donated to the city by M.F. and Alan B. Wise in memory of their father and mother, W.B. and May L. Wise, is hereby set aside and is to be, under the name of “The Wise Memorial,” forever maintained as an athletic field in the city for the holding thereon of open-air games and athletic contests, meets and amusements. It is the desire of the city council that such grounds and all facilities in connection therewith be made available, without charge, to all citizens of the city desiring to use the same for any such named purposes; provided, however, to ensure the maintenance and upkeep of said grounds and in accord with the wishes of the donors, reasonable fees for admittance to such grounds may be charged persons desiring to witness athletic contests. The admittance fees so charged and collected shall be used for the benefit of the property and of athletic contests and the upkeep of the grounds and facilities.

Parks.
All city-owned parks within the corporate limits of the city shall be closed every day from 12:00 midnight until 5:00 a.m., and it shall be unlawful for any person to loiter, idle, wander, stroll, or play in such parks during such period when they are closed. However, if anyone applies for permission to carry out an activity in a park during such hours and the city manager determines that such activity will not create a disturbance or public nuisance, such manager shall have authority to issue a special permit for such activity.
(b) 
Trail de Paris walking and nature trails.
All Trail de Paris walking and nature trails shall be closed every day beginning thirty (30) minutes after sundown until thirty (30) minutes before dawn and it shall be unlawful for any person to loiter, idle, wander, stroll, or play on the Trail de Paris during such period when it is closed. However, if anyone applies for permission to carry out a special activity in a park during such hours and the city manager determines that such activity will not create a disturbance or public nuisances, such manager shall have the authority to issue a special permit for such activity.
(c) 
Special events.
In accordance with article 5.06, the special events committee may permit the closure of city-owned parks for events which meet the definition of a special event during the hours which the park would normally be open to the public and for such lengths of time as the committee deems appropriate, depending on the nature of the event.

A portion of Section 8 of Lake Crook is hereby designated as a city park and shall be known as Lake Crook Park. Such park shall be closed every day from 10:00 p.m. until 5:00 a.m. Such park may be closed at any time when deemed necessary for the protection of the public health and welfare. It shall be unlawful for any person to loiter, idle, wander, stroll, or play in such park during such period when it is closed. However, if anyone applies for permission to carry out an activity in the park during hours when it is closed and the city manager determines that such activity will not create a disturbance or public nuisance, such manager shall have authority to issue a special permit for such activity.
(b) 
Special events.
In accordance with article 5.06, the special events committee may permit the closure of Lake Crook Park for events which meet the definition of a special event during the hours which the park would normally be open to the public and for such lengths of time as the committee deems appropriate, depending on the nature of the event.

Any and all mining or drilling is prohibited in all city parks which presently exist or which might be created in the future.
