As used in this article, the term “food establishment” shall include all places, spaces, rooms, buildings, cellars, basements, sites, vehicles or conveyances, including fixtures, furnishings and equipment, in which food is kept, stored, processed, packed, served, transported or otherwise handled for the purpose of keeping with intent to sell or exchange, preparing for sale, offering for sale, exposing for sale, selling or serving.

For the purpose of regulating food service, food service establishments and food establishments, the unabridged form of the 1976 edition of the United States Public Health Service’s Food Service Sanitation Manual, and the 1982 Retail Food Store Sanitation Code, copies of which are on file in the office of the city clerk, are hereby adopted and made a part of this code as if fully set out in this code, and the provisions thereof shall govern all matters covered therein within the city, except those provisions which may be in conflict with other provisions of this code.

Any person violating any of the provisions of this article shall be guilty of a misdemeanor and upon conviction shall be fined in accordance with the general penalty provided in section 1.01.009, and each day’s continuance of any violation described in this article shall constitute and be deemed a separate offense.
