There is hereby created a police reserve unit under the conditions,
rules and regulations set out in this division.

The purpose of the police reserve unit shall be to assist and
augment the regular police department of the city.

The police reserve unit shall be composed of such number of
members as is determined by the chief of police, subject to the right
of the city council to expand or decrease the membership or completely
disband the unit.

The chief of police shall be the director and sponsor of the
police reserve unit. He shall aid in developing and establishing policies,
directives, standard operating procedures, and programs of the unit.

The police reserve unit shall have a commanding officer appointed
by the chief of police and such other officers as the chief of police
shall designate.

The commanding officer of the police reserve unit shall be directly
responsible to the chief of the police department and shall carry
out such policies, orders, and directives as are issued by or through
the chief of police or his designated assistant. The commanding officer
shall develop, with the advice of the chief of police, organizational
policies and standard operating procedures. The chief of police shall
be responsible for seeing that all police reserve officers maintain
compliance with the provisions of the state commission on law enforcement,
pursuant to V.T.C.A., Occupations Code, ch. 1701, as amended. The
commanding officer shall be responsible for seeing that the overall
program of the unit is properly adhered to and for developing and
maintaining continued assignments or instructions as directed or delegated
by the chief of police.

Any person who is of good character, who is twenty-one (21)
years of age or older, and who is interested in the objectives and
purposes of the reserve organization may apply for membership in the
police reserve unit. The applicant must be able to be licensed by
the state commission on law enforcement officer standards and education
as a peace officer for the state. The applicant must be able to successfully
complete physical, psychological, and medical evaluations to standards.
He is also subject to a background investigation, a polygraph test,
a meeting with an oral interview board, and final evaluation by the
chief of police.

Each new member of the police reserve unit shall take the prescribed
oath of office and be issued a badge and commission. He shall then
report to the identification office of the police department for fingerprinting
and photographing. The commanding officer shall issue his equipment
and obtain a receipt.

No member of the police reserve unit shall belong to any other
organization that responds to emergencies. Any current reserve officer
that belongs to another emergency organization shall be allowed to
continue membership until such time the officer separates from the
police reserve unit.

Regular meetings of the police reserve unit shall be held at
the police station on the third Monday of each month at 7:30 p.m.
Such meetings shall be presided over by the commanding officer of
the reserve unit or his designated assistant, under the supervision
of the chief of police. To such an extent as possible, parliamentary
rules shall be observed and proper order maintained. During these
monthly meetings, instruction will be had on police efficiency.

Each member of the police reserve unit shall attend monthly
meetings and devote a minimum of eight (8) hours per month to regular
police activity. A member may be absent from a monthly meeting with
the commanding officer’s permission. Members may not miss more
than three (3) meetings in a calendar year with unexcused absences.
Notice of absence should be given as far in advance as possible where
a work schedule or assignment is concerned.

Each member of the police reserve unit shall wear the uniform
while performing duties pertaining to police department activities.
Members shall also wear the uniform to monthly meetings as determined
by the commanding officer of the police reserve unit.

(a)
Each
member of the police reserve unit shall furnish his own belts and
holster, both of which shall be black in color. He shall also furnish
his own pistol or revolver which shall be .38 caliber or larger. All
weapons shall be kept in excellent service condition at all times.
(b)
Any
police reserve officer who has attained full certification as a basic
peace officer for the state and is licensed as such shall be considered
as being on duty at all times. An officer meeting those requirements
is authorized to carry, at his discretion, a weapon for which he has
been certified. The weapon shall be kept out of view of the general
public. If a weapon is carried, the officer must have his badge on
his person. The weapon is not to be carried on his person where he
works or while he is a representative of any other employment.
(c)
Any
police reserve officer who has not attained full certification as
a basic peace officer for the state shall be considered as being on
duty only when he is in uniform and assigned to ride patrol or work
special events. This officer shall not carry a weapon on his person
when he is off duty.

At all times when a member of the police reserve unit is accompanied
by a member of the regular police department, the member of the regular
police department will be the person in charge of the operation being
accomplished.

(a)
Any
member of the police reserve unit may, of his own volition, terminate
his membership. In addition, any member may be removed, suspended,
or demoted for:
(1)
A flagrant and serious violation of reserve unit or police department
rules and regulations; or
(2)
Repeated minor violations of reserve unit or police department rules
and regulations.

The supervisory staff of the police reserve unit shall make
recommendations to the chief of police on disciplinary actions regarding
members of the unit. The chief of police will make the final determination.
The members of the police reserve unit serve at the discretion and
under the administration and discipline of the chief of police.

(b)
When
a member of the police reserve unit is terminated for any reason,
all uniforms, badges, identification, and other equipment shall be
returned to the supply sergeant in reasonable condition. A release
will then be signed to clear a terminating member of any obligation
in this regard.

Nothing within this division shall be construed to, in any way
or manner, affect the operation of the police department or the rights
and privileges of the members thereof under the municipal civil service
as provided in Local Government Code, chapter 143.
