As used in this article, the following terms shall have the meanings indicated:
JUNKYARD
A lot, land or structure, or part thereof, used primarily for the collection, storage and/or sale of wastepaper, rags, scrap metal or discarded material or for the collecting, dismantling, storage and salvaging of machinery or autos and automotive vehicles not in running condition and for the sale of parts thereof, except as accessory to a principal industrial use of the lot. Storage of two or more inoperative motor vehicles shall constitute a junkyard. Lack of current New York State inspection stickers on motor vehicles shall be prima facie evidence that the motor vehicles are inoperative.
A. 
It shall be unlawful for any person within the limits of the Village to maintain, operate or conduct a junkyard for the sale or storage of wrecked automobiles or salvaged parts and accessories of such wrecked automobiles or used junk, scrap iron or old metals, rags, bones, bottles, rubber, rope and old machinery or to conduct a junk business.

B. 
It shall be unlawful for any person within the limits of the Village to engage in the junk business by conducting or operating a junkyard for the sale or storage of wrecked automobiles or salvaged parts and accessories of such wrecked automobiles or used junk, scrap iron or old metals, rags, bones, bottles, rubber, rope and old machinery or to engage in the junk business or in the business of salvaged automobiles or the storage of wrecked and salvaged automobiles.

A. 
Any person who violates any provision of this article shall, upon conviction thereof, be subject to a fine not to exceed $250 or to imprisonment for a term not to exceed 15 days, or both.
B. 
Each day in which any violation of this article shall continue shall constitute a separate offense and shall be punishable as such.
C. 
Notwithstanding the foregoing, the Village may at any time seek injunctive or other relief, including compensatory and punitive damages, in any court of competent jurisdiction to enforce this article or to recover for the violation thereof.
