[Adopted at time of adoption of Code (see Ch. 1, General
Provisions, Art. II)]
A.
Except for violations specifically enumerated to be misdemeanors and for violations of Chapter 450, Zoning (for which penalties are provided therein), a violation of any provision of this Code shall be a municipal civil infraction, for which the fine shall be not less than $250 nor more than $500 for the first offense, and not less than $500 nor more than $2,500 for subsequent offenses, in the discretion of the court.
B.
Notwithstanding Subsection A, in accordance with the mandatory penalties imposed by MCL 28.457(3), a violation of Subsection A of § 232-2 of this Code shall be a civil infraction, subject to a civil fine of $1,000 for each violation, and no other fine or sanction. Five hundred dollars of the fine collected shall be remitted to the Township as the law enforcement agency responsible for enforcing the ordinance. If state law is amended to remove this mandatory penalty, then a violation of Subsection A of § 232-2 shall be subject to the penalties provided for other civil infractions.
C.
In addition to the fine, as provided above, all costs, damages, expenses,
and attorney fees incurred by the Township in enforcing its ordinances
shall be an additional penalty to be paid to the Township in the discretion
of the court.
D.
For purposes of this section, "subsequent offense" means a violation
of an ordinance committed by the same person within 12 months of a
previous violation of the ordinance for which that person admitted
responsibility or was adjudicated to be responsible; provided, however,
that offenses committed on subsequent days within a period of one
week following issuance of the citation for a first offense shall
all be considered separate or first offenses.
E.
Each day that a violation occurs shall constitute a separate offense.
The misdemeanor and civil infraction penalties provided for
by this article shall not be the exclusive remedy available for violation
of this Code. The Township may, in lieu of or in addition to the penalties
provided herein, revoke any license, or seek an injunction in a court
of appropriate jurisdiction to abate such violation.
