(a) 
"Municipal buildings" means a building or portion of a building owned or leased by the City of Plainfield.
(b) 
"City agency" means any entity under the general auspices of the City of Plainfield.
(c) 
"Smoke" means the gases, particles, or vapors released into the air as a result of combustion, electrical ignition or vaporization, when the apparent or usual purpose of the combustion, electrical ignition or vaporization is human inhalation of the by-products, but excluding incense or similar products inhaled solely for olfactory purpose so long as the products do not contain tobacco or nicotine. The term "smoke" includes, but is not limited to, tobacco smoke, electronic cigarette vapors and marijuana smoke.
(d) 
"Smoking" means engaging in an act that generates smoke, such as for example, but not limited to, possessing a lighted pipe, a lighted hookah pipe, a lighted cigar, an operating electronic cigarette, a lighted cigarette of any kind or a lighted smoke inhalation device of any kind that generates smoke, or the act of lighting or igniting a pipe, a hookah pipe, a cigar, a cigarette or smoke inhalation device of any kind that generates smoke.

(a) 
Smoking is prohibited in municipal buildings and City agencies except in designated areas where the words "Smoking Permitted" are posted.
(b) 
Facilities owned or leased by the City of Plainfield and used for holding sports events, such as football, baseball, basketball, or providing ambulatory recreation, are excluded from this regulation.

(a) 
Any municipal building or agency affected by this regulation shall be identified by the signs posted by the department/division thereof with letters at least one (1) inch in height stating "Smoking Permitted" or "Smoking Prohibited", or the Smoking Prohibited international symbol. The letters or symbol shall contrast in color with the sign.
(b) 
The sign may indicate that violators are subject to a fine.
(c) 
Every sign required by this section shall be located so as to be clearly visible to the public and employees.

(a) 
Any official and/or employee found to have violated this regulation, after notice and an opportunity to be heard, may be subject to disciplinary action pursuant to the appropriate State Statute(s), Department of Personnel Services Regulation(s), Plainfield Municipal Code or other relevant regulatory guidelines.
(b) 
Any member of the public who smokes in a nondesignated area in violation of this regulation is subject to a fine not to exceed Twenty-Five Dollars ($25.00).
(c) 
The penalty recovered under the provisions of this regulation shall be recovered by and in the name of the Plainfield Board of Health.

(a) 
Department/division heads shall have the right to withhold the services of his/her respective department/division to any member of the public who smokes in an area which smoking is prohibited, provided that the department/division head and/or City employee informs that person that smoking is prohibited. Services shall not be denied if the member of the public complies with the rules governing smoking after receiving notice.
(b) 
Any person waiting for service in a municipal building/agency who leaves the building to smoke, shall upon re-entering the building/agency have the right to regain his/her position in order of the persons receiving those services.

(a) 
The Health Officer shall be responsible for executing or enforcing this article against any member of the public in violation hereof.
