No unauthorized person shall uncover, make any connections with or opening into, use, alter or disturb any public sewer or appurtenance thereof without first obtaining a written permit from the Borough.
2. 
There shall be three classes of permits for connections to the Borough's wastewater facilities: residential, commercial and industrial. In all cases, the owner shall make application for a permit to connect to the Borough's wastewater facilities on a special form furnished by the Borough. The permit application shall be supplemented by wastewater information including plans and specifications and other information considered by the Borough pertinent to the administration of this Part. The permit and inspection fee may be amended from time to time by Borough Council and shall be paid to the Borough at the time the application is filed.

All costs and expenses incidental to the installation and connection of the building sewer shall be borne by the owner(s). The owner(s) shall indemnify the Borough and Authority from any loss or damage that may directly or indirectly be occasioned by the installation of the building sewer.

A separate and independent building sewer shall be provided for every building, except where one building stands at the rear of another on an interior lot and no private sewer is available or can be constructed to the rear building through an adjoining alley, court, yard or driveway. In such a case, the building sewer serving the front building may be extended to the rear building and the whole considered as one building sewer. The Borough and Authority assumes no obligation or responsibility for damage by or resulting from any single connection aforementioned. For any subdivision of property in which there is a common sewer lateral, there shall be a separation of the building sewers prior to approval of such subdivision. A sewer tap shall be created for the divided property and utility easements shall be indicated on subdivision plat.

Existing building sewers may be used for connection of new buildings only when they are found, on examination and tested by the Borough, to meet the requirements of this Part.

The size, slope, alignment, materials of construction of a building sewer, and the methods used in excavating, placing of pipe, jointing, testing and backfilling the trench, shall all conform to applicable rules and regulations of the Borough or Authority. In the absence of specific provisions the Borough shall provide such requirements. Service lines will not be installed when the service line passes over or through premises which at the time may be the property of persons other than the owner of the premises to be supplied, unless the owner of the premises supplied assumes all liability and furnishes a right-of-way agreement in a form satisfactory to the Council or its duly authorized representative.

Whenever possible, the building sewer shall be brought to the building at an elevation below the basement floor. In all buildings in which any building drain is too low to permit gravity flow to the public sewer, wastewater carried by such building drain shall be lifted by an approved means and discharged to a building sewer draining to the Borough sewer.

No person shall make connection of roof downspouts, foundation drains, sump pumps, areaway drains or other sources of surface runoff or groundwater to a building sewer.

The connection of the building sewer into public sewer shall conform to the requirement of the Uniform Construction Code (UCC) or other applicable rules and regulations of the Borough, Authority or the procedures set forth in appropriate specification of the ASTM. All such connections shall be made gastight and watertight and verified by the Borough. Any deviation from the prescribed procedures and materials must be approved by the Borough before installation.

The applicant for the building sewer permit shall notify the Borough when the building sewer is ready for inspection prior to its connection to the public sewer. The connection and testing shall be made subject to the approval of appropriate Borough officials. The Borough reserves the right to inspect the plumbing on any premises and, if it shall be found not in conformity with the rules of the Borough, to refuse water service until the objectionable or improper work is corrected.

All excavation for building sewer installation shall be adequately guarded with barricades and lights so as to protect the public from hazard. Streets, sidewalks, parkways, and other public property disturbed in the course of the work shall be restored in a manner satisfactory to the Borough.

The Borough shall not issue a permit for any class of connection to the Borough wastewater sewers or wastewater treatment facilities unless there is sufficient capacity, both hydraulically and/or organically (as determined by the Borough), not legally committed to other users, in the wastewater sewers and treatment facilities to convey and adequately treat the quantity of wastewater which the requested connection will add to the system. The Borough may permit such connection if there are legally binding commitments to provide the needed capacity.

The customer shall be responsible for the maintenance and repair of the service line from the main, to and including the customer's premises. All breaks or blockages in the sewer lateral must be repaired promptly by the proper owner. The service lateral installed by the consumer shall not be less in size and quality than prescribed by the Borough and shall be laid not less than the required depth below the surface as specified by the Borough and shall not be covered until the lateral is inspected by the Borough. If defects in workmanship or material are found, water service shall not be turned on until such defects are remedied. All plumbing connections shall be installed in accordance with the ICC Plumbing Code in force at the time of the installation of the service line.

The service line from the main to the premises shall be kept in good condition by the customer under penalty of discontinuance of service by the Borough.

All abandoned sanitary sewer laterals shall be immediately disconnected at the property line and properly blocked by the property owner to prevent water infiltration into the system at his own expense and he shall be liable for all damages that may arise by reason of any abandoned service lateral remaining attached to the sanitary sewer main in front of his property or wherever the same may be. It shall be the responsibility of the contractor to disconnect sewers and plug according to Borough specs.

All new and replacement plumbing installations connected to the Borough of Edinboro sewer system shall comply with the applicable version of the IPC as referenced by the PA UCC Act 45 of 1999. The following sections are amended to read:
A. 
708.3.5 Building drain and building sewer junction. There shall be a cleanout near the junction of the building drain and the building sewer. The cleanout shall be located outside the building wall and shall be brought up to finished ground level. An approved cleanout shall be used at the location to serve as a required cleanout for both the building drain and building sewer. The termination of the cleanout shall be perpendicular to the ground from which it is concealed. (See drawing in appendix).
B. 
1002.6 Building traps shall be provided with a cleanout and a relief vent or fresh air intake on the inlet side of the trap. The size of the relief vent or fresh air intake shall not be less than 1/2 the diameter of the drain to which the relief vent or air intake connects. Such relief vent or fresh air intake shall be carried above grade and shall be terminated in an outlet located outside the building.
