For the purposes of this Article, the following terms shall have the meanings indicated:
JUNK
Old iron, steel, brass, copper, tin, lead or other base metals; old cordage, ropes, rags, fibers or fabrics; old rubber; old bottles or other glass; bones; wastepaper and other waste or discarded material which might be prepared to be used again in some form; any or all of the foregoing; and motor vehicles no longer used as such to be used for scrap metal or stripping of parts.
JUNK DEALER
A person who operates a junkyard, as defined herein, within the city.
JUNKYARD
A yard, lot or place, covered or uncovered, outdoors, containing junk as defined hereinbefore.
PERSON
Any person, firm, partnership, association, corporation, company or organization of any kind.
All persons operating or maintaining a junkyard must enclose such portion thereof as faces any public street or highway by a solid masonry or frame wall or fence. Said wall or said fence must be closed and must be of a height of 10 feet above the sidewalk grade at the property line. If the fence is built of wood, the same must be painted and thereafter maintained by the owner or operator of the junkyard. Any gate in said fence or wall cannot be over 25 feet in maximum width, and said gate must also be of a solid construction to the height of 10 feet as aforesaid and must be kept closed, except when trucks or other traffic are entering or leaving the junkyard.
No junk shall be piled higher than 10 feet in height and shall be arranged so that the same cannot be seen from ground level across the street from where said junk is piled or stored.
The wall or fence and gates provided for in this Article must be built according to the Building Code of the City of Atlantic City,[1] and permits for the construction thereof must be obtained from the Superintendent of Buildings of the City of Atlantic City.

All persons operating or maintaining a junkyard must have a wall or fence erected as required by this article within 200 calendar days after the effective date of this article.

Any person violating any of the terms and provisions of this article shall, upon conviction in the Municipal Court of the City of Atlantic City, be punished for each offense by a fine not to exceed $2,000 or by imprisonment for any term not exceeding 90 days in the county jail or in any place provided by the municipality for the detention of prisoners, or both.
