A. 
This article shall be known and may be cited as the "Carlisle Fee Ordinance." Reference herein to other chapters of the Code, in which certain fees set forth in this article are authorized, are not intended to imply that such referenced chapters have not been amended following initial enactment.
B. 
Upon the written request of the Carlisle Area School District or the County of Cumberland, Carlisle Borough Council, in its sole discretion and giving full consideration to the circumstances, shall have the power to waive all or any portion of the fees established under §§ 120-4, Building permits; 120-5, Electrical Code; 120-6, Plumbing fees and licenses; 120-8, Sidewalks and curbs; 120-10, Street permits and inspections; and 120-11, Fire prevention, of this article.
C. 
The fees established in Chapter 120 may be amended from time to time by resolution of Borough Council; provided, however, that any resolution amending any fee established by ordinance in Chapter 120 shall reference the section and any applicable paragraphs of Chapter 120 that reference such fee, and that any new fee categories not contained in Chapter 120 must first be established by ordinance of Council.

Permit issuance fees. Issuance fees are used to defray costs incurred by the Borough in reviewing and processing the application and plan(s), including the preliminary review of the site location identified in the application, and issuing and processing the permit.

B. 
General permit inspection fees. General inspection fees are used to defray costs incurred by the Borough in spot inspection(s) of permitted work and/or subsequent inspection(s) after the permitted work has been completed, to ensure compliance with the permit and these regulations.

Underground facilities (e.g., pipelines, buried cable with pedestals, conduit, manholes, headwall, inlet and grate). This fee is calculated on the total linear feet of the facility or facilities being permitted within the right-of-way.

Underground facilities (first 50 feet or fraction thereof), each section: $45.
(b) 
Additional underground facilities (each 100 feet or fraction thereof): $10.
(2) 
Surface openings (e.g., service connections performed independently of underground facility installation, pipeline repairs), each opening: $45.

Aboveground facilities (e.g., poles, guys and/or anchors if installed independently of poles).

C. 
Construction inspection fees for required public improvements. In the case of a land development or subdivision, in order to cover Borough of Carlisle construction inspection costs for infrastructure improvements, including but not limited to water system, sanitary sewer system, stormwater management, street network, sidewalk and other incidental improvements, the developer or subdivider shall be charged a sliding scale fee calculated on actual construction costs. Upon completion of the development or development phase or improvement construction or improvement construction phase in the case of a subdivision without other development, the developer or subdivider shall submit to the Borough detailed paid invoices itemizing all such improvement construction costs or other evidence of proper costs. Upon approval of the paid invoices and other information by the Borough, the Borough shall calculate the construction fee utilizing the sliding scale percentage fee schedule listed below, shall bill said party the resultant amount and shall be reimbursed said amount by the party so billed. (See Chapter 226.)

The review fee for a stormwater management plan is $35 per hour for review of the plan by the Borough Engineer. (See Chapter 217, Stormwater Management § 217-15.)

The applicant submitting a stormwater management plan shall deposit with the Borough the sum of a minimum of $1,000, possibly more, to be held in a non-interest-earning escrow account by the Borough for purposes of covering the charges of the Borough Engineer and any other professional consultants utilized by the Borough to review, comment and make recommendations with respect to the plan filed. In the event the escrow account becomes exhausted, the applicant shall deposit additional funds into the escrow account in increments of $1,000. Upon approval of the stormwater management plan, the Borough will return all remaining funds in the escrow account to the applicant.

The amount of the initial deposit and any additional funds required to be deposited as noted above may be modified from time to time by resolution of Borough Council.

The fee for use of the stormwater pond facility, payment of which is a requisite for area development or subdivision or land development within the scope of Chapter 217, Stormwater Management, and within the subbasin area described pictorially therein, is $1,000 per acre or part thereof of land being so developed or subdivided. Fee for handicapped or disabled veteran parking spaces. Pursuant to Section 3354(d)(2) of the Pennsylvania Vehicle Code, Act of June 17, 1976, P.L. 162,[2] the following fee is hereby enacted and ordained by the Borough of Carlisle for each handicapped or disabled veteran parking space requested, said fee to be paid by the applicant prior to any reservation of the parking space for the handicapped person or disabled veteran: cost of installation of handicapped parking space sign, $290 as an administrative fee and $20 per year payable at the beginning of each year of use of said space.

(1) 
A minimum charge of $110 and a charge per hour of $110, pro rata thereafter, for court appearance before a District Justice or any court of competent jurisdiction for any matter related to preparation for and pursuit of any litigation or for services related to any other municipal claim authorized by law.
(2) 
There shall be added to the above amounts the reasonable out-of-pocket expenses of counsel in connection with each of these services, including Sheriff's and Prothonotary's costs.
(3) 
The amount of fees determined as set forth above shall be added to the Borough's claim in each matter.

B. 
Fees for testing of new water mains and other matters are as follows:
(1) 
A fee of $50 shall be charged by the Borough each time a test is made on a valve-to-valve section of a new water main or a portion thereof. This fee shall be charged each time there is a test, whether it is an initial test or subsequent test.
(2) 
The fee for meters with ECR Touch Read capability and any accessories/appurtenances shall be the cost of such item(s) to the Borough as determined by its most recent purchase.

C. 
The following fees shall be charged for testing the accuracy of water meters:

The fee for turning water on after a discontinuance of service shall be $30.

The fee for a permit to obtain water service for a reasonable period of construction not to exceed 90 days shall be $25.

The fee for the transfer of an existing account or the establishment of a new account shall be $30.

The use of the personnel of the Borough of Carlisle shall be at the rate of 135% of the hourly rate of said worker.
C. 
In addition to the above rates, an administration fee of 15% of the entire charge as hereby established shall be assessed and collected.

The applicant will be responsible for arranging any paying for any backhoe, as well as having digging and preparing percolation test holes. All costs and liability associated with excavation and backfill of test pits/percolation hoes shall be the responsibility of the applicant. The Sewage Enforcement Officer (SEO) will provide water for percolation testing provided access to the test site can be made without vehicle damage.
C. 
An applicant will be required to hire a state certified soil scientist for all fill site evaluations, alternate type systems and any situation where a soil scientist is needed as the SEO shall determine. Applicant will be responsible for paying for the soil scientist. The SEO is required to verify all soil testing at the SEO's regular rates.

The fee for a third-party bond issuance for a non-Borough-related entity which desires to issue bonds through a Borough-related entity shall be charged at the rate of 1% of the gross principal amount of the bond issue, or $10,000, whichever amount shall be less.

The fee for persons taking the police civil service examination for employment as a police officer in the Carlisle Police Department shall be $20 and shall be payable at the time of submission of the application. No fee shall be charged for examinations given for promotions of police officers within the department.

All amounts for the rental of real estate owned by the Borough of Carlisle shall be established by resolution of the Borough Council, from time to time, and may thereafter be changed by resolution of the Borough Council, from time to time, as it deems proper, necessary and in the best interest of the Borough.

A storage fee of $10 per vehicle is hereby imposed upon the owners of vehicles impounded under lawful Borough authority, which fee shall include the day of impound and the day of owner's retrieval, without proration for a portion of a day.

In case of the loss, defacement or destruction of any amusement device permit, the operator to whom such permit was issued shall apply to the Borough Manager for a duplicate permit, which shall be issued by the Borough Manager to such operator upon payment of a fee of $5. A nonresidential use fee of $800 for use of the Borough's North Middleton Township yard waste and composting facility is hereby established, which fee shall be applicable on an annual basis, for the unlimited use of such facility during hours of normal operation.

A fee of $0.75 per hour shall be charged for the use of any Carlisle Borough vehicle charging station that is available for public use. Such a fee shall be charged at a rate of $0.75 for each hour, with that hourly rate prorated for actual time used. The fee charged shall apply in addition to any applicable vehicle parking fee charged at the location where the vehicle charging station is located.
